Assumption of Risk
The client agrees that their participation in the Event is voluntary. Furthermore, the client agrees to assume any risk associated with participating in the event, and releases VELOCITY FINANCIAL INC. from any and all claims of loss or damages that may arise during the Clients participation. Such releases are without limitation, and include attorneys’ fees, personal injury, property damage, and any other losses or damages suffered by the Client.
Total Indemnification
You will indemnify, hold harmless and defend VELOCITY FINANCIAL INC. (as well as its members, employees, instructors, vendors, independent contractors, service professionals and affiliated entities) from and against any and all claims, expenses, costs, causes of action and damages (including reasonable attorney’s fees) resulting from or arising out of your actions, your participation in the Event or your violation of this Agreement or applicable law.
Personal well-being
The client hereby warrants that they are physically fit and capable of participating in even without undue risk.
Right to cancel
VELOCITY FINANCIAL INC. maintains the right to deny the client participation in the event if they deem that participation would risk loss or damage or any party. VELOCITY FINANCIAL INC. maintains the right to remove the client from the event at any time. The client acknowledges that being removed from the event does not warrant a refund.
Event at your own risk participation
The client acknowledges and agrees that they are not guaranteed to achieve any specific personal, professional or financial results, or earn any specific amount on income or results of any kind by participation in the event. VELOCITY FINANCIAL INC. makes no promises, representations or warranties concerning the viability of any goal, aspirations or endeavors the client may identify or choose to pursue during or as a result of your participation in the event. VELOCITY FINANCIAL INC. makes no representation or warranties concerning treatments, diagnosis or anything pertaining to medical or mental conditions. The information is informative and not definitive. The client agrees to participate in the event at their own risk. The client is solely responsible for any decisions and actions that result from your use of such information, products, and services. VELOCITY FINANCIAL INC. does not provide psychological, investment, financial or medical advice. In addition, you are solely responsible for taking all actions necessary to ensure your medical safety, which shall include but is not limited to, advising VELOCITY FINANCIAL INC. (as well at it’s members, staff, instructors, vendors, independent contractor, service professions and affiliated entities) of any allergies, or other conditions that may require special attention or accommodations provided.
No refunds
Unless otherwise personally discussed with VELOCITY FINANCIAL INC. or it’s staff, the registration fee for the event is non-refundable for any reason; regardless of whether or not you attend the event, or any portion of it. All funds paid by you are deemed and earned by VELOCITY FINANCIAL INC. upon receipt. VELOCITY FINANCIAL INC. may however in its sole discretion issue a refund or credit upon agreement by the client and VELOCITY FINANCIAL INC. or it’s staff.
Accommodations
The client is responsible for paying their own transportation, parking, accommodations, meals and anything else associated with attending the event.
Ownership rights and proprietary information
VELOCITY FINANCIAL INC. and its affiliated entities own all right, title and interest (including all intellectual property rights throughout the world) relating to any and all works of authorship, designs, know-how, ideas, course materials, products, services and information made by VELOCITY FINANCIAL INC. (or its affiliated entities) or conceived or reduced to practice, in whole or in part, by VELOCITY FINANCIAL INC. (or its affiliated entities) in connection with the Program or any Proprietary Information (as defined below). You agree that all materials provided by VELOCITY FINANCIAL INC. as part of the Program, which are confidential and proprietary in nature, will constitute VELOCITY FINANCIAL INC.’s “Proprietary Information.” You will hold in confidence and not disclose or copy any Proprietary Information, except with the prior written consent of VELOCITY FINANCIAL INC..
Intellectual Property
Client recognizes and acknowledges that the trademarks, service marks, trade names, logos, patents and copyrighted materials (the “VELOCITY FINANCIAL INC. Intellectual Property“) associated with the Program and their associated websites are proprietary to VELOCITY FINANCIAL INC. and its affiliated entities. Client will not take any action that would interfere with or infringe upon the VELOCITY FINANCIAL INC. Intellectual Property, including, but not limited to: (i) duplication or creation of works (including any derivative works) that are the same or substantially similar to the VELOCITY FINANCIAL INC. Intellectual Property; (ii) registration, creation or use of trademarks, service marks or domain names that are the same or substantially similar to the VELOCITY FINANCIAL INC. Intellectual Property; (iii) use, manufacture, import, or sales of any product or service that infringes upon the VELOCITY FINANCIAL INC. Intellectual Property ; and (iv) any action that would pass off or create the appearance of an association with or endorsement by VELOCITY FINANCIAL INC..
Consent to use likeness
By participating in the event, the client expressly grants VELOCITY FINANCIAL INC. and its staff consent to capture, record, replicate, reproduce, publish, share, and otherwise disseminate your name, likeness, photos, and video in any and all promotional, educational or other means derived from the event or any portion of the event.
Modification
VELOCITY FINANCIAL INC. may modify or amend any of the terms and conditions contained in this agreement at any time and in VELOCITY FINANCIAL INC.’s discretion, by posting a change notice or a new version of the agreement on applicable event websites, or by otherwise advising you of the amendment/modification.
Limitation of liability
VELOCITY FINANCIAL INC. (as well as its members, employees, instructors, vendors, independent contractors, service professionals and affiliated entities) shall not be liable for any indirect, incidental, special or consequential damages of any nature (including but not limited to claims for personal injury, property damage, losses of revenue, profits, use or data) arising in connection with this Agreement or your participation in the Event, even if VELOCITY FINANCIAL INC. or its affiliated entities knew or should have known of the possibility of such damages. Further, VELOCITY FINANCIAL INC.’s aggregate liability arising with respect to this Agreement and the applicable event will not exceed the total amounts paid or payable by you under the Program.
Governing Law; Class action waiver
This Agreement will be governed by, and construed in accordance with, the laws of the Province of Alberta, without reference to rules governing choice of laws. You irrevocably and unconditionally waive, to the fullest extent permitted by law, any right you may have to participate as a representative or member of any class of claimants in any class action against VELOCITY FINANCIAL INC., or any of its affiliated entities, now or hereafter pending relating to transactions evidenced by this Agreement or similar transactions.
Legal Age
By entering into this agreement, the client is representing and acknowledging that they are of legal age of majority.
Drug & Alcohol
The client agrees that under no circumstances are any drugs or alcohol permitted in the event. The client agrees to not attend the event under the influence of any drugs or alcohol and acknowledges that VELOCITY FINANCIAL INC. and its staff reserve the right to remove the client from the event if there are reasons to believe the client is under any influence of substances. The client acknowledges being removed from the event for the above reason does not warrant a refund.
Relationship of parties
You agree that by participating in the Event you are acting as an independent contractor, and you are responsible for determining your own business activities. Nothing in this Agreement will create a partnership, joint venture, agency, franchise, sales representative, or employment relationship between the Parties.
Applicable law
This waiver agreement shall be governed by the laws of ALBERTA CANADA. Any legal proceeding, claim, or lawsuit relate to the clients participation in Master Your Mind 2.0 shall take place exclusively in EDMONTON ALBERTA CANADA.
Covid-19
The client acknowledges and accepts the risks in accordance to Covid-19. Although VELOCITY FINANCIAL INC., its staff and the event centre will be doing everything they can to provide a safe environment, they cannot be held liable for any possible cases, or exposure to Covid-19. The client agrees that they will not attend the event if they have knowledge of testing positive for Covid-19, or if they have symptoms of such.
By agreeing to this waiver, the client acknowledges that VELOCITY FINANCIAL INC. cannot be held legally liable for any of the above.
